Any adult 21+ with a valid photo ID from any state, or a passport from any country, can shop New York's licensed dispensaries. Getting it home is the part the law doesn't allow.

Can out-of-state visitors buy cannabis in New York? Yes. Adults 21+ with a valid government photo ID from any US state, or a passport from any country, can shop at any licensed New York dispensary. No residency requirement, no medical card, no New York license. The harder part comes at the end of the trip, because nothing bought here can legally leave the state with you.

That second fact is what the travel questions keep circling back to. The weekend works when the shopping is sized to the stay.

What counts as valid ID

The Office of Cannabis Management accepts any of the following, as long as it shows a photo and a date of birth:

  • A driver's license or non-driver ID from any US state, Washington DC, a US territory, or a Canadian province
  • A passport issued by the United States or any other country
  • A US armed forces ID card
  • Other valid federal, state or local government photo ID, including IDNYC

Bring the physical card. Every licensed shop checks ID at the door or the counter, and the age line is 21.

How much a visitor can buy

Visitors live under the same limits as residents. Adults 21+ can possess up to three ounces of cannabis flower and up to 24 grams of concentrated cannabis, a category that covers vapes, oils and edibles. State rules cap edibles at 10 mg of THC per serving and 100 mg per package. For anyone new to edibles or to New York products, start low, go slow.

Shops can set tighter limits on hot items when inventory runs short, and the limit is a possession limit, so it applies to everything in the bag, not per store.

Tax and the receipt math

A 13 percent retail cannabis tax applies to every adult-use sale, split 9 percent state and 4 percent local. Cannabis is exempt from regular New York sales tax, so the menu price plus 13 percent is close to the number at the register. Payment methods vary by shop, so check before assuming a credit card will work.

Finding a licensed shop

The Hudson Valley has licensed shops in most of the towns weekenders base in: Beacon, Kingston, New Paltz, Hudson and Poughkeepsie among them. Unlicensed smoke shops still sell cannabis in plain sight, and an out-of-towner has no way to tell the difference by looking. Verify licensed status via the OCM QR code at cannabis.ny.gov before buying. Licensed products carry the state's universal symbol and a QR code that links to the lab results.

Where it can't go: the state line and the airport

This is the part that trips up visitors. State guidance is blunt: it is illegal to cross state lines with adult-use cannabis. That holds even when the destination is another legal state, and it holds for a drive across the George Washington Bridge into New Jersey as much as for a flight to California.

  • Flying. Airport screening is federal. Marijuana remains illegal under federal law, and TSA says it refers anything illegal it finds during screening to law enforcement.
  • Amtrak. Amtrak prohibits marijuana on its trains and in its stations, in any form and for any purpose, including medical use and travel between states where it is legal.
  • Canada. The Canadian government says taking cannabis across its border in either direction is illegal without Health Canada authorization, and that applies to Canadians heading home from a New York trip.
  • Delivery. New York shops deliver only to addresses inside the state. A delivery order cannot be sent to a home in Connecticut or New Jersey.

The plan for leftovers

Buy for the trip, not for the year. A pre-roll pack or a single package of edibles covers most weekends, and shopping on the last morning rather than the first leaves the least behind.

For what is left, New York has a clean option. Adults 21+ can give cannabis to another adult 21+ within the possession limits, as long as nothing comes back in exchange. A friend who lives here is the obvious recipient. What is illegal is any version of the trade: cannabis for cash, for a favor, or bundled as a "gift" with something sold.

Where visitors can't consume

New York state law prohibits cannabis consumption on state-owned land and in public spaces. State guidance also rules out motor vehicles, businesses, restaurants including their patios, hookah and cigar bars, and most public and state parks and beaches. Driving after consuming is illegal. Hotel and rental rules are set by the property, so ask before booking. New York has authorized consumption lounges in law, but the state register lists no on-site consumption licenses as of 2026.
