These Terms of Service ("Terms") govern your use of Hudson Valley Cannabis Club at hudsonvalleycannabisclub.com and any related subdomains or services we operate ("the Services", "we", "us", "our"). By using the Services you agree to these Terms. If you don't agree, don't use the Services.
Who can use the Services
The Services publish editorial content about the legal cannabis industry for adults 21 years of age or older. By using the Services, you represent that you are 21+ and that accessing cannabis-related content is legal in your jurisdiction.
We reserve the right to refuse service, close accounts, or remove content that violates these Terms or applicable law.
Editorial content — not legal, medical, or financial advice
Everything we publish is editorial content. It is not:
- Medical advice. Cannabis affects individuals differently; consult a licensed clinician for health questions.
- Legal advice. Cannabis laws vary by state and change frequently; consult a licensed attorney for legal questions.
- Financial advice. Nothing on this site constitutes investment, tax, or financial guidance.
- A substitute for a dispensary's own product information. Always verify product details, pricing, and licensing at the shop itself.
We make reasonable efforts to keep content accurate, but laws, product availability, retailer operations, and prices change faster than any publication can track. Always verify active licensing via the New York Office of Cannabis Management's QR portal at cannabis.ny.gov before visiting a retailer.
Cannabis-specific rules
Cannabis remains federally illegal and is regulated state-by-state. Our content assumes New York State's legal framework for adults 21+. Accessing this site from a jurisdiction where cannabis remains illegal for adult use doesn't create any legal authorization to purchase, possess, or consume cannabis.
New York state law prohibits cannabis consumption on state-owned land and in public spaces. We do not encourage violations of this or any other cannabis statute.
Your account
If you create an account, you're responsible for keeping your password secure. Don't share credentials. Notify us promptly if you believe your account has been compromised.
You can close your account at any time from your profile settings. We may close accounts that violate these Terms or become inactive for extended periods.
User-generated content
If you post comments, reviews, gallery images, or any other content ("User Content") on the Services, you represent that:
- You own or have rights to the content you post
- It doesn't violate anyone else's rights (copyright, privacy, publicity, etc.)
- It isn't illegal, defamatory, threatening, harassing, or deceptive
- It doesn't promote cannabis sales by unlicensed retailers, underage consumption, or medical claims
By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to display and distribute it on the Services. You retain ownership of your content.
We may remove or moderate User Content at our discretion, with or without notice, for any reason.
Prohibited uses
You may not use the Services to:
- Violate any law, regulation, or third-party right
- Post content that promotes illegal activity, including unlicensed cannabis sales
- Impersonate another person or misrepresent an affiliation
- Scrape, crawl, or systematically extract content beyond normal browser use (search engines excluded; see our robots.txt)
- Upload malware, viruses, or any code that could damage the Services or another user's system
- Probe, scan, or test the vulnerability of the Services without written permission
- Advertise, solicit sales, or send unsolicited commercial messages
Links to third-party sites
The Services include links to external sites (dispensaries, brands, news sources, booking platforms). We don't control these sites and aren't responsible for their content, privacy practices, or availability. Some external links are affiliate links; see our Affiliate Disclosure for how we handle those.
Intellectual property
Except for User Content (owned by you) and clearly credited third-party material (photographs, for instance, often credited to individual photographers via Unsplash), all content on the Services is owned by us or our licensors. You may read, share links, and quote briefly for commentary. You may not republish, redistribute, or use our content for commercial purposes without written permission.
Disclaimer of warranties
The Services are provided "as is" and "as available". We make no warranties, express or implied, about the completeness, accuracy, reliability, or availability of the Services or any content on them.
Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability for any claim related to the Services is limited to the greater of $100 or the amount you paid us in the prior 12 months.
Nothing in this section limits liability for fraud, gross negligence, or any liability that cannot be limited under applicable law.
Indemnification
You agree to indemnify us against any claims, damages, or expenses arising from your violation of these Terms, your User Content, or your misuse of the Services.
Governing law and disputes
These Terms are governed by the laws of the State of New York without regard to conflict-of-laws rules. Any dispute arising from these Terms or the Services will be resolved in the state or federal courts located in New York County, New York, and you consent to the jurisdiction of those courts.
Changes to these Terms
We may update these Terms from time to time. If we make material changes, we'll post a notice on this page and update the "Last updated" date. Continued use of the Services after an update means you accept the updated Terms.
